Illinois Supreme Court to Determine Constitutionality of Ending Cash Bail

After dozens of Illinois State’s Attorneys sued to keep cash bail in place, the Illinois Supreme Court delayed the statewide implementation of the end of cash bail, pending their final ruling. Since the SAFE-T Act first passed in 2021, House Republicans have argued that ending cash bail is unconstitutional. When asked about the status of the legal challenges aimed at keeping cash bail in place, Governor Pritzker launched an insult, saying, “Well I know, you know, it’s the last refuge for those that cannot win at the ballot box to try and take it to court to try and have it overturned,” Pritzker said. Today, the Illinois Supreme Court will hear oral arguments in the case, with a ruling expected to come later this spring or summer.
